In this Privacy Statement, we explain how PowerGo processes personal data obtained through the use of its mobile application (“the App”).

PowerGo is a tradename of Powerfield Netherlands B.V., established at Veerdijk 40 D, 1531MS in Wormer.

Scope of the privacy statement

Our privacy policy applies to all personal data PowerGo processes of everyone who has (had) contact with PowerGo, such as our visitors, customers and business contacts, in all domains related to PowerGo.

What do we mean by the term Personal Data?

Personal data are all data that can be traced back to an individual. The data that, depending on the type of contact you have with us, are received and stored by PowerGo may consist of:

  • Your given name and family name;
  • your company name;
  • the number of your company’s registration at the Chamber of Commerce;
  • your email address;
  • your telephone number(s);
  • the payment method you have chosen;
  • your invoice address;
  • the model of your car, your charging tag and plug type, and;
  • charging data (location, type of plug, charging power, power consumption, charging time and period).

Why and how does PowerGo use personal data?

PowerGo processes data in the performance of its services to the user; see PowerGo’s terms of use. In some cases, PowerGo uses an external party for processing personal data. This processor observes at least the same level of personal data security as PowerGo has laid down in this Privacy Statement. PowerGo has concluded a processing agreement with this processor in which the same obligations as in this Privacy Statement are laid down.

PowerGo receives the data described above directly from the user whenever they use the App, create an account and fill in certain details or when a user contacts PowerGo’s customer service.To ensure optimal use of the App, data relating to the use of the App are also stored. PowerGo hereby informs you that it is handling this data very carefully.

Using any type of personal data will at all times be in accordance with the applicable laws and regulations in terms of personal data protection.

Any other personal data to be entered are used for administrative purposes only.

Personal data are entered on a voluntary basis, and this is done for optimal functioning of the App. Users can set their own preferences at various places in the App. For instance, push notifications of offers can be enabled or disabled. These preferences can be changed or turned off at any time.

How are personal data stored?

PowerGo stores the entered data in the App for offline use. Data are also stored (as a backup) on an external server. Of course, this information is encrypted. The stored data can be viewed in your PowerGo App. If these data are incorrect, you can change them in “settings” “my account” in the App. ®

The collected data are stored within the European Economic Area (“EEA”). If personal data are nevertheless transferred to or stored at a destination outside the EEA, PowerGo ensures that this is done in a safe and lawful manner. In that case, PowerGo will take appropriate measures to ensure that the personal data are protected as much as possible, such as agreeing with the recipients of default data protection clauses drawn up by the European Commission.

Cookies

PowerGo currently does not use cookies. Cookies are small data files providing the possibility to better tailor content to the user of a site. Should PowerGo start using cookies, we will notify you in advance.

Data for marketing purposes

Push notifications and/or emails with personal offers are used to inform you as best as possible about the latest news involving the PowerGo app.

Sharing data with third parties

PowerGo does not allow the use of personal data by third parties for commercial, charitable or idealistic purposes.

Providing data to the government

PowerGo will only provide your personal data to investigative authorities, government agencies or regulators when required to do so by applicable law or by order of a government authority, and only to the extent necessary to combat fraud or criminal activities.

Purchasing goods and/or services from third parties

If goods and/or services are purchased from third parties through the App, a different privacy policy may apply. PowerGo has no influence on this and cannot be held liable for this.

Rights of the user of the App

Right of inspection

A user of the App has the right to request PowerGo to inspect the data PowerGo has available on that user at any time.The request can be made in ”my account”. Requests are processed within 30 days at the latest.

Right to rectification and supplement

A user of the App has the right to have his personal data corrected and supplemented if they are incorrect or incomplete.

Right to be forgotten

A user of the App has the right to request PowerGo to remove all data that PowerGo has of him. After that request, PowerGo removes all data that can be traced back to the user, except for the data that PowerGo must or may keep according to law.

This request will not be granted in case of any outstanding invoices.

The request can be made in ”my account”.

Right to restriction of processing

In certain circumstances, a user of the App has the right to restrict the processing of his data. In that case, PowerGo may no longer use these data, but may still keep them stored. If a user believes that he is entitled to this, he may contact PowerGo’s customer service.

Right to data portability

A user of the App has the right to obtain the relevant personal data, which he has provided to PowerGo, in a structured, common and machine-readable form, so that he can store these data himself or transfer them to someone else.

The user may download these data in ”my account”.

Right to object

A user of the App has the right to object to the processing of his data if he disagrees with the manner in which these data are processed. For instance, a user may request that his data are no longer used for personalised advertisements in the App.

Right of automated individual decision-making

In certain cases, a user of the App has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on him or which otherwise significantly affects him.

Right to information

A user of the App has the right to receive an understandable and transparent explanation about how PowerGo handles his personal data and what rights he may exercise in that regard. This Privacy Statement, therefore, explains in detail which data PowerGo collects from users and how PowerGo handles those data.

Changes

PowerGo reserves the right to change its privacy policy. PowerGo, therefore, advises you to consult this Privacy Statement on a regular basis. If PowerGo makes important changes that may affect the processing of personal data, it will notify its users beforehand.

You always have the right to file a complaint about the way PowerGo handles your data. We prefer to resolve this complaint for you and you may submit it to our Data Protection Officer.
